Welcome to Elith! These Terms and Conditions (“Terms”) govern your use of our services, including our website, mobile app, and diet food delivery service (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a contract to use the Services.

2. Subscriptions and Orders
 
We offer various subscription plans and meal order options. Please carefully review the details of each plan and menu before placing an order.
All orders must be placed through our website or mobile app.
Prices are subject to change without prior notice.
We reserve the right to cancel or refuse any order at our sole discretion.
Payment can be made through Cash on Delivery (COD), UPI, debit card, or credit card.
3. Delivery
 
We deliver to select areas within Chennai. Please see our delivery zone map for more information.
We deliver twice daily, once before 9:30 AM in the morning and again before 9:00 PM in the evening.
You are responsible for providing a valid delivery address and ensuring someone is available to receive the delivery during these times. We are not responsible for missed deliveries due to incorrect addresses or no one being present.
We recommend refrigerating or freezing meals immediately upon receipt, particularly for deliveries made in the evening.
In case of unforeseen circumstances beyond our control, such as accidents or vehicle breakdowns, deliveries may be delayed. We will do our best to inform you of any delays and deliver your meals as soon as possible.
4. Cancellations and Changes
 
You may cancel or modify your subscription at any time. However, cancellations or modifications made after the billing cycle has begun will not be refunded.
You may freeze your subscription for up to 5 days per month. Please contact us at least 24 hours in advance to freeze your subscription.
5. Refunds
 
Elith does not offer refunds for:
Undelivered meals (except in cases of significant delays or non-delivery)
Damaged meals (except in cases of significant food quality issues)
Dissatisfaction with the food
Cancellations after the billing cycle has begun
Exceptions may be made at Elith’s sole discretion in cases of significant food quality issues or prolonged delivery delays. In such cases, compensation may be offered in the form of a credit for future orders.
6. Food Quality Issues
 
In the event of a food quality issue, please contact Elith within 24 hours of receiving the delivery. We will investigate the issue and may offer a credit for future orders as compensation.
7. Protein Levels
 
Elith may offer suggestions for appropriate protein levels based on customer needs. However, the ultimate decision regarding desired protein levels lies with the customer.
Elith is not responsible for any health consequences arising from customer-chosen protein levels. Customers are encouraged to consult with a healthcare professional before choosing a high-protein plan.
8. Medical Disclaimer
 
Elith’s food products are not intended to diagnose, treat, cure, or prevent any medical condition. Customers should consult with a healthcare professional before starting any new diet, including one provided by Elith.
Elith is not responsible for any medical problems that may occur while consuming its food products.
9. Intellectual Property
 
The Services and all content contained therein, including text, graphics, logos, images, and software, are protected by copyright and other intellectual property laws.
You may not modify, copy, distribute, transmit, display, publish, sell, license, or create derivative works of any content without our express written permission.
10. Disclaimer of Warranties
 
The Services are provided “as is” and without any warranties of any kind, express or implied. We disclaim all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any defects will be corrected.
 
11. Limitation of Liability
 
We will not be liable for any damages arising out of or in connection with your use of the Services, including direct, indirect, incidental, consequential, special, punitive, or exemplary damages.
 
12. Governing Law and Jurisdiction
 
These Terms shall be governed by and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Chennai, India.
